Online supermarket sales must also comply with the Supermarket Shelf regime

On September 10, 2021, Resolution 926/2021 (“Resolution”) of the Secretariat of Domestic Trade was published in the Official Gazette. The Resolution complements the Supermarket Shelf Law No. 27,545, providing new obligations for online supermarket stores.

The Resolution provides that:

(I) the products listed in the Resolution shall be displayed on the homepage of the retailer’s website, by category and by increasing price order following the principle of neutrality with no promotional highlights or legends;

(ii) said products shall be displayed with the legend “LOWER PRICE per unit of measure. Law 27,545”;

(iii) domestic products produced by the following organizations shall be displayed with the legend “BUY SME“:
a. SMEs,

b. family productions, farmer or native agriculture sectors,

c. the popular economy sectors,

d. those produced by cooperatives and/or mutual aid associations.


The Resolution provides for a 60 calendar days term to adapt the websites. This term ends on November 9, 2021.
