On October 26, 2023, the Argentine National Institute of Industrial Property (INPI) issued Regulation No. 2023-351, announcing the modification of official fees effective as from December 1, 2023.

In general terms, the new fees represent a significant increase, ranging from 200% to 400% in comparison to the current fees.

Regarding patents, the fee structure for annuity payments has been modified. Until now, annuities were divided into three blocks: 1st to 3rd, 4th to 6th, and 7th to 20th. However, starting from December 1, 2023, a new structure will be implemented, divided into five staggered blocks with progressive increases as follows: 1st to 3rd, 4th to 6th, 7th to 10th, 11th to 15th, and 16th to 20th.

Additionally, INPI has decided to apply an additional fee for voluntary divisional patent applications. From December 1, 2023, divisional applications will double the application and substantive examination fees compared to regular applications.

If you wish to avoid the fee increase for new or pending matters, we recommend that you provide us with your instructions as soon as possible, and at any event well before December 1, when the new official fees will become effective.
